Terms and liability limits

This website currently provides product information only. It does not create accounts, accept subscription payments, issue API keys, or provide hosted AI responses. Publication of this draft does not mean that you have accepted a service contract.
1. Scope and acceptance
These terms are proposed for Winthos AI services offered by Win's VPN Inc. They would apply to hosted models, apps, subscriptions, and API access only when those services launch and the account flow presents the final version. Before creating an account after subscription, a user must affirmatively accept the then-current Terms and Acceptable Use Policy. The service must record the version, timestamp, account, and consent event. A link or preselected checkbox alone is not acceptance.
2. Accounts and access
You must provide accurate account information, protect credentials and API keys, and promptly revoke compromised keys. You are responsible for activity under your account unless applicable law provides otherwise. API key creation is limited to active Plus, Pro, and Max subscribers when the feature becomes available. Access may be limited, suspended, or revoked for nonpayment, suspected compromise, unlawful conduct, or material policy violations, with notice when reasonable.
3. Plans, usage, and billing
Final checkout must display the plan, billing interval, amount, renewal terms, included usage, cancellation method, and any applicable taxes before payment. API usage is billed separately from subscription fees. Planned API rates are $1 per 1 million input tokens and $5 per 1 million output tokens. Final supported models, rate limits, usage calculation, billing cycle, and any spending controls must be shown before API access opens. Recurring charges require express consent. Cancellation stops future renewals, subject to any nonrefundable charges permitted by law and disclosed at purchase.
4. User content and output
You retain rights to content you submit, subject to the limited rights needed to operate the service under its final privacy notice. You are responsible for having authority to submit that content and for evaluating and using any output. Similar or inaccurate outputs may occur. Do not submit sensitive, regulated, or third-party information until the applicable product's data handling terms and safeguards have been published and reviewed.
5. Human oversight and professional decisions
AI output is informational and may be wrong, incomplete, outdated, or unsafe. It is not a substitute for a licensed clinician, attorney, emergency responder, or qualified security professional. Do not rely on a model alone for diagnosis, treatment, legal advice, emergency response, deployment, or security decisions. Obtain appropriate human review, test code and mitigations, and confirm security testing is authorized in writing. In an emergency, contact local emergency services.
6. Acceptable use and third-party rights
You must comply with the Acceptable Use Policy, applicable law, and the rights of other people. You may use security capabilities only on systems you own or are expressly authorized to test. You may not use the service to cause harm, facilitate unauthorized access, or evade safeguards. You are responsible for your own actions and for consequences of deploying or acting on output.
7. Service limitations and warranties
To the extent permitted by applicable law, the service and output would be provided as available without a guarantee of uninterrupted operation, fitness for a particular purpose, perfect accuracy, absence of vulnerabilities, or a specific outcome. We will use reasonable care in operating the service, but published benchmark results or product descriptions do not guarantee performance in every case. Nothing here limits rights or warranties that cannot lawfully be excluded.
8. Liability allocation
To the extent permitted by applicable law, Win's VPN Inc. and its personnel would not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the service, including lost profits, data, or business opportunities. To the same extent, total liability for claims connected with a paid service would be limited to the amount the claimant paid for that service in the 12 months before the event giving rise to the claim. For a free service, the proposed cap is $100. These limits would not apply where prohibited by law, including liability that cannot legally be excluded or limited. They do not excuse the company's own legal obligations.
9. User responsibility for claims
To the extent permitted by law, you would defend and reimburse Win's VPN Inc. for third-party claims, damages, and reasonable costs caused by your unlawful use, violation of the Acceptable Use Policy, infringement of another person's rights, or deployment of output without required authorization or review. This provision would not apply to harm caused by the company's own misconduct or where consumer law bars such an obligation.
10. Changes, termination, and disputes
The final terms must identify how material changes are announced and when renewed acceptance is required. You may stop using the service and cancel future renewals through the account or payment method disclosed at checkout. The company may discontinue or change features with any notice and refund rights required by law. No choice of law, arbitration clause, or class-action waiver is included in this draft; these require separate legal and business decisions.
Legal review is required before these terms are presented for acceptance. The final account flow also needs a product privacy notice, payment terms, a working cancellation path, and a durable record of explicit consent.
